2015 Experienced Rider 1 Day License Class

This class is for riders who already have basic skills and have been riding without a permit or license or have been riding on a learner permit and want to earn their liscense without taking the two and 1/2 day Basic RiderCourse. It is similar to the BRC except the speeds are higher and riders will ride their own motorcycle. It is also an excellent refresher course for practicing and renewing basic riding skills. There is an informal classroom component that discusses safety concepts based on your past riding experiences and current knowledge.

To particpate in the class you must bring your motorcycle, and proof of ownership of the motorcycle or written permission from the owner of the motorcycle.

All participants must:

1.Provide riding gear (long sleeves, full-fingered gloves, long pants, over-the-ankle sturdy boots, bandana) including a DOT approved helmet.
2.Must provide a safe, street-ready motorcycle or scooter (no three-wheelers) that will pass the coach's T-CLOCS safety inspection.
3.Must successfully achieve the objectives of Exercise 1, Control at Low Speed, and must successfully achieve the objectives of subsequent exercises to continue. Note: The Coach conducting the course is responsible for making this determination.
4.Pass the riding and written evaluation portion of the course. Riders successfully completing this course receive a GMSP license waiver card. Participants that earn a "liscense waiver card" will not have to take the driving test to get their class M license.

REFUND POLICY
There are NO refunds. By registering for a class you are reserving a seat in a particular class for a particular day and time. When you register and pay for your class, it means you have reserved a seat in a specific class. You are expected to be at your class for those dates and times. Your registration and course fee does not give you a seat in future classes, it does not add your name to a new roster nor does it reschedule you into another date if you should miss or be late for any part of your original course. It is your responsibility to make sure you arrive where you need to be, before class begins. Due to variables beyond our control, such as weather, some course times may need to be extended. Allow additional time in your course schedule in case a session runs later than scheduled. Class hours may be extended or adjusted during any session. We ask that you do not commit to any other appointments on the days or evenings of your scheduled classes.

ATTENDANCE/LATENESS POLICY
There is no time in these classes to review missed material. Classes start promptly, it is your responsibility to arrive for class at least 15 minutes before the stated class time. Being late to the start of any portion of the course, may result in being dropped from the course without refund.

CANCELLATION POLICY
GeorgiaMotorcycleRiders.com reserves the right to cancel any and all classes. We must have a minimum of 3 students per class to hold a class. In rare cases it may be necessary for us to cancel a class. In these cases, we will make a reasonable attempt to find alternative meeting times, dates and/or locations for affected students but cannot guarantee we will be able to accommodate everyone. If GeorgiaMotorcycleRiders.com cancels or reschedules a course, you may choose to reschedule or receive a refund as long as a class has not begun. If GeorgiaMotorcycleRiders.com has to reschedule after a class begins, the student will only be allowed to reschedule. We will not pay for or reimburse students for any incidental or consequential expenses or damages related to the cancellation or rescheduling of their class.

RESCHEDULING POLICY
You may reschedule your class up to 20 calendar days before your class starts without having to purchase a new registration. Rescheduling after the grace period requires you to purchase a new registration in a future class. There are no refunds.

COUNSELING OUT OF CLASS POLICY
Motorcycling is not for everyone. The course is conducted at a pace that results in successful completion for most novice riders. The Coaches will help you learn to the best of your ability. However, if you have significant difficulty or become a risk to yourself or others, as determined by you or your coach, you will not be permitted to continue to ride. Some students may discover this for themselves during the course. At other times, struggling or uncertain students may be counseled out and unable to continue in the riding sessions. Our trained coaches are required to maintain the safety of all participants. Any student creating an unsafe condition, as determined by the coaches, will not be allowed to continue in the course. There are NO refunds or reschedules available for non-completion of the course.

NO GUARANTEE OF LICENSE
Although successful completion of a GMSP-approved course currently serves to waive the DDS riding skill test and knowledge test, GeorgiaMotorcycleRiders.com does not guarantee that completion of our program will ensure that the individual will be issued a license in the State of Georgia. The State of Georgia has the final say in issuing any and all license.

STUDENTS UNDER THE AGE OF 18
If a student is under the age of 18, a parent or legal guardian MUST accompany the student to the first class meeting to sign a waiver form. Students under the age of 18 will NOT be allowed to attend unless a parent or legal guardian is present at the first classroom session (NO EXCEPTIONS). Students under the age of 18 that successfully complete the Basic RiderCourse earn a 90-day License Waiver. However, to get their license, the student must be at least 17 years of age BEFORE the 90-day waiver expires. They must also comply with the requirements of Joshua’s Law.

INTENTIONAL UNSAFE ACT
Please note that unsafe acts will result in the dismissal of the student without refund.

ADDITIONAL EXPERIENCED RIDER COURSE TERMS & CONDITIONS
Have 6 months and 500 miles riding experience
Have a street legal motorcycle (it will be inspected; check with you local state trooper office for details)
Provide proof of ownership of the motorcycle to be used in the course or proof of ownership and written permission from the owner for you to use the bike and provide proof of liability insurance for the motorcycle covering you while you use it.
Bring a parent or legal guardian to the course if under 18
Have a valid driver’s license or motorcycle permit
Wear a DOT approved helmet (it will be inspected, no novelty or non-DOT helmets)
Eye protection (faceshield, goggles, or glasses)
Wear full fingered gloves, preferably leather
Wear long sleeved shirt or jacket
Wear sturdy pants (no shorts)
Wear leather boots that cover your ankles
Be in proper state of mind and not under the influence of legal or illegal drugs, medicine, or alcohol

WAIVER & INDEMNIFICATION
By registering to participate in any activity or course offered by GeorgiaMotorcycleRiders.com you or the parents of a student under the age of 18 must agree to the following and be willing to sign the following Waiver and Indemnification.

MOTORCYCLE SAFETY COURSE WAIVER & INDEMNIFICATION rev. 08/08

Participation in this course requires physical stamina, motor coordination, and mental alertness. The undersigned hereby attests that he/she has no known physical or mental limitations and has not used any form of alcohol, prescription or non-prescription drugs that could impair his/her performance in this course. Participants under 18 years of age must have this form signed by a parent or guardian.

I. READ CAREFULLY: THIS SECTION IS A LEGAL RELEASE, ASSUMPTION OF RISK, WAIVER AND COVENANT NOT TO SUE AGREEMENT


In consideration of Allen Air Systems LLC d.b.a Allen Sales and GeorgiaMotorcycleRiders.com, the Motorcycle Safety Foundation, the owner of the training motorcycle, and the owner of the land upon which training occurs, including their members, employees, officers and/or agents (the “Safety Course Providers”), furnishing services, equipment, and/or curriculum to enable me to participate in the Motorcycle Safety Course, I agree as follows:


I fully understand and acknowledge that: (a) there are DANGERS AND RISK OF INJURY, DAMAGE, OR DEATH that exist in my use of motorcycles and motorcycle equipment and my participation in the Motorcycle Safety Course activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL OR TOTAL PARALYSIS, OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY, OR DEATH; (c) these risks and dangers may be caused by the negligence of the Safety Course Providers; the negligence of others, including other Safety Course participants; and may arise from foreseeable or unforeseeable causes; and (d) by participating in these activities and/or using the equipment, I, on behalf of myself, my personal representatives and my heirs, hereby assume all risks and all responsibility, and agree to release the Safety Course Providers for any injuries, losses and/or damages, including those caused solely or in part by the negligence of the Safety Course Providers, or any other person. If I have brought a motorcycle to use in the Safety Course, I also agree that this release applies to any damage that occurs to it during the Safety Course.


I agree and understand that, on behalf of myself, my personal representatives and my heirs, I am relinquishing any and all rights I now have or may have in the future to sue the Safety Course Providers for any and all injury, damage, or death I may suffer arising from motorcycle riding or its equipment, including claims based on the Safety Course Providers’ negligence.


I HAVE READ THIS RELEASE AGREEMENT AND BY SIGNING BELOW I AGREE IT IS MY INTENTION TO ASSUME ALL RISKS AND RELEASE THE ABOVE-NAMED SAFETY COURSE PROVIDERS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. I have had the opportunity to ask any questions about the above waiver and release and I understand its terms and meaning.

In consideration of Allen Air Systems LLC d.b.a Allen Sales and GeorgiaMotorcycleRiders.com, the Motorcycle Safety Foundation, the owner of the training motorcycle, and the owner of the land upon which training occurs, including their members, employees, officers and/or agents (the “Safety Course Providers”), furnishing services, equipment, and/or curriculum to enable me to participate in the Motorcycle Safety Course, I agree as follows:


I, on behalf of myself, my personal representatives and my heirs, agree to hold harmless, defend, and indemnify the Safety Course Providers from any and all claims, suits, or causes of action by others for bodily injury, property damage, or other damages which may arise out of my use of motorcycles and motorcycle equipment or my participation in the Motorcycle Safety Course activities, including claims arising from the Safety Course Providers’ or any other party’s negligence.


I HAVE READ THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT AND BY SIGNING I AGREE IT IS MY INTENTION TO ACCEPT LEGAL RESPONSIBILITY AND PAY FOR ANY LOSS FOR CLAIMS OR LAWSUITS AGAINST THE ABOVE-NAMED SAFETY COURSE PROVIDERS ARISING FROM MY PARTICIPATION IN THE MOTORCYCLE SAFETY COURSE. I have had the opportunity to ask any questions about the indemnification and hold harmless section and I understand its terms and meaning.

PERSONAL GUARANTEE

I, the participant and/or purchaser (hereinafter Guarantor(s)), do hereby personally guarantee the payment to Allen Air Systems, dba Allen Sales and GeorgiaMotorcycles.com for Guarantor’s purchase of the ticket(s) to attend the motorcycle training class. In the event that payment is not made or the payment is later withdrawn as a charge back or for any other reason, the Guarantor(s) does hereby promise to pay in cash the full amount within 3 business days of notification by Allen Air Systems LLC, dba Allen Sales and GeorgiaMotorcycleRiders.com. Furthermore, the Guarantor does hereby authorize and empower any attorney of any court of record of the state of Georgia or elsewhere to appear for and to enter judgment against the Guarantor, in favor of Allen Air Systems LLC, dba Allen Sales and GeorgiaMotorcycleRiders.com for any sums due from the transaction, plus interest at 25% annual interest rate compounded daily, reasonable attorney's fees, with costs of suit, release of errors, without stay of execution, consents to immediate execution upon any such judgment and that any execution that may be issued on any such judgment may be immediately levied upon and satisfied out of any personal property or funds of the undersigned, waives all rights to have personal property last taken and levied upon to satisfy any such execution; hereby ratifying and confirming all that said attorney may do by virtue hereof. The Guarantor hereby waives and releases all benefit and relief from any and all appraisement, stay or exemption laws of any state now in force or hereafter to be passed. This guarantee is a continuing one, binding upon the undersigned and the heirs and legal representatives of the undersigned, and shall continue in force until written notice of revocation thereof shall be received from Allen Air Systems LLC, dba Allen Sales and GeorgiaMotorcycleRiders.com by the Guarantor, its successors or assigns. This guaranty shall be construed and enforced under the laws of the State of Georgia.
