Terms & Conditions

REFUND POLICY
There are NO refunds.  Very simply, you are buying a ticket for a reserved seat at a particular event at a particular date and time, and just like concert tickets or show tickets, they are non-refundable. By registering for a class you are reserving a seat in a particular class for a particular day and time.  When you register and pay for your class, it means you have reserved a seat in a specific class.  You are expected to be at your class for those dates and times.  Your registration and course fee does not give you a seat in future classes, it does not add your name to a new roster nor does it reschedule you into another date if you should miss or be late for any part of your original course.  It is your responsibility to make sure you arrive where you need to be, before class begins. 

You must successfully complete the Online Virtual eCourse Classroom prior to the date of this class but no more than 25 days before.  You will not be able to attend the riding portion of the class if you have not successfully completed the virtual classroom before the date of this class and will forfeit your payment for the class. 

Due to variables beyond our control, such as weather, some course times may need to be extended.  Allow additional time in your course schedule in case a session runs later than scheduled.  Class hours may be extended or adjusted during any session.  We ask that you do not commit to any other appointments on the days or evenings of your scheduled classes.  

ATTENDANCE/LATENESS POLICY
There is no time in these classes to review missed material.  Classes start promptly, it is your responsibility to arrive for class at least 15 minutes before the stated class time.  Being late to the start of any portion of the course, may result in you being dropped from the course without refund.

CANCELLATION POLICY
GeorgiaMotorcycleRiders.com reserves the right to cancel any and all classes.  We must have a minimum of 5 students per class to hold a class.  In rare cases it may be necessary for us to cancel a class.  In these cases, we will make a reasonable attempt to find alternative meeting times, dates and/or locations for affected students but cannot guarantee we will be able to accommodate everyone.  If GeorgiaMotorcycleRiders.com cancels or reschedules a course, you may choose to reschedule or receive a refund minus $50 for the eCourse portion of the class as long as a class has not begun.  If GeorgiaMotorcycleRiders.com has to reschedule after a class begins, the student will only be allowed to reschedule.  We will not pay for or reimburse students for any incidental or consequential expenses or damages related to the cancellation or rescheduling of their class.

RESCHEDULING POLICY
You may reschedule your class up to 20 calendar days before your class starts without having to purchase a new registration.  A $75 rescheduling fee will apply for changes before the 20 day period. Rescheduling between 19 and 14 days before the scheduled start of your class will require a $100 rescheduling fee.
Thirteen (13) days and closer to your class there are no refunds or reschedules and you forfeit the price of your ticket. However, if attempting to reschedule after the 13th day before your class, and if the class is sold out and we have a waiting list, then we may, but are not obligated to, help you sell your spot in the class.  If we do resell your ticket there will be a $100 rescheduling fee applied to your rescheduling credit. You will only be allowed to reschedule and there are no refunds.

COUNSELING OUT OF CLASS POLICY
Motorcycling is not for everyone.  The course is conducted at a pace that results in successful completion for most novice riders.  The Coaches will help you learn to the best of your ability.  However, if you have significant difficulty or become a risk to yourself or others, as determined by you or your coach, you will not be permitted to continue to ride.  Some students may discover this for themselves during the course.  At other times, struggling or uncertain students may be counseled out and unable to continue in the riding sessions.  Our trained coaches are required to maintain the safety of all participants.  Any student creating an unsafe condition, as determined by the coaches, will not be allowed to continue in the course.  There is no time to teach you the use of a clutch if you have no previous clutch experience from other motor vehicles or motorcycles.  There are NO refunds or reschedules available for non-completion of the course.

NO GUARANTEE OF LICENSE
Although successful completion of a GMSP-approved course currently serves to waive the Georgia DDS riding skill test and knowledge test, GeorgiaMotorcycleRiders.com does not guarantee that completion of our program will ensure that the individual will be issued a license in the State of Georgia.  This means that if you successfully complete the requirements of our course we will issue you a Georgia DDS Motorcycle Safety Program Waiver showing you successfully completed the course.  When taken to the DDS office they should reissue your driver license with the motorcycle endorsement and without you having to take their written and riding exam assuming you are qualified to have or are qualified to continue to have a license in the state of Georgia. The State of Georgia has the final say in issuing any and all license.

STUDENTS UNDER THE AGE OF 18
If a student is under the age of 18, a parent or legal guardian MUST accompany the student to the first class meeting to sign our waiver form.  Students under the age of 18 will NOT be allowed to attend unless a parent or legal guardian is present at the first classroom session (NO EXCEPTIONS).  Students under the age of 18 that successfully complete the Basic RiderCourse earn a 90-day License Waiver.  However, to get their license, the student must be at least 17 years of age and redeem the waiver certificate BEFORE the 90-day waiver expires.  They must also comply with the requirements of Joshua’s Law.

INTENTIONAL UNSAFE ACT
Please note that unsafe acts will result in the dismissal of the student without refund.

ADDITIONAL EXPERIENCED RIDER COURSE TERMS & CONDITIONS
Have 6 months and 500 miles riding experience
Have a street legal motorcycle (it will be inspected; check with you local state trooper office for details)
Provide proof of ownership of the motorcycle to be used in the course, or proof of ownership and written permission from the owner for you to use the bike, and provide proof of liability insurance for the motorcycle covering you while you use it.
Bring a parent or legal guardian to the course if under 18
Have a valid driver’s license or motorcycle permit
Wear a DOT approved helmet (it will be inspected, no novelty or non-DOT helmets)
Eye protection (faceshield, goggles, or glasses)
Wear full fingered gloves, preferably leather
Wear long sleeved shirt or jacket
Wear sturdy full length pants (no shorts)
Wear leather boots that cover your ankles
Be in proper state of mind and not under the influence of legal or illegal drugs, medicine, or alcohol

WAIVER & INDEMNIFICATION
By registering to participate in any activity or course offered by GeorgiaMotorcycleRiders.com you or the parents of a student under the age of 18 must agree to the following and be willing to agree to and sign the following Waiver and Indemnification.

SAFETY COURSE -- GENERAL RELEASE, WAIVER & INDEMNIFICATION AGREEMENT rev. 01/22
In consideration for the Motorcycle Safety Foundation, Inc. (“MSF”), the entity sponsoring the training Allen Air Systems, LLC dba Allen Sales & GeorgiaMotorcycleRiders.com, the owner of the training motorcycle (if not owned by the undersigned), and the owners of the premises upon which training
occurs, including each of their affiliates, subsidiaries, members, employees, officers, coaches, instructors, aides, and/or agents (collectively, the “Released Parties”), permitting the undersigned to participate in this Safety Education and Training Course (the “Course”), I, the undersigned Participant, agree to all of the following:
Participation in the Course requires physical stamina, motor coordination, and mental alertness. I hereby attest that I have no known physical or mental limitations and have not used any form of alcohol, or prescription or non-prescription drugs that could impair my performance in the Course. Participants under 18 years of age must have this form signed by a parent/guardian in person at the training location, or the parent/guardian may sign without appearing in person, in which case this form must be NOTARIZED.
I fully understand and acknowledge that (a) this Agreement is intended to be as broad and inclusive as permitted by the laws of the State in which the Course is conducted; (b) I have been advised of and agree to waive, on behalf of myself, my personal representatives and my heirs, all rights and benefits flowing from any state statute that would otherwise limit the scope of this Agreement or the undertakings and releases contained herein; (c) if any portion of this Agreement is held invalid or legally unenforceable, then the balance shall, notwithstanding, continue in full force and legal effect; and (d) I have had the
opportunity to read this entire Agreement and ask any questions about it, and I fully understand its terms and meaning.

READ CAREFULLY: THIS IS A GENERAL RELEASE, WAIVER, ASSUMPTION OF RISK & COVENANT NOT TO SUE
I fully understand and agree that: (a) there are DANGERS AND RISKS OF INJURY, DAMAGE, OR DEATH that exist in my participation in the Course, and in my use of motorcycles and motorcycling equipment (“Motorcycling Activities”); (b) my participation in the Course and Motorcycling Activities may result in injury or illness including, but not limited to, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL OR TOTAL PARALYSIS, OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY, AND DEATH; (c) these risks and dangers may be caused by negligence of Released Parties, other Course participants, or others, and may arise from foreseeable or unforeseeable causes; and (d) by participating in the Course and Motorcycling Activities, I, on behalf of myself, my personal representatives and my heirs,
hereby knowingly and voluntarily assume all risks and all responsibility, and agree to release the Released Parties for any injuries, losses and/or damages, including those caused solely or in part by negligence of the Released Parties or any other person. If I have brought a motorcycle or helmet to use in the Course, I also agree that this release applies to any damage that occurs to or from my motorcycle or helmet during the Course.
I fully understand and agree that, on behalf of myself, my personal representatives and my heirs, I hereby covenant not to sue, and am relinquishing any and all rights I now have or may have in the future to sue the Released Parties for any and all injury, damage, or death, whether known or unknown, that I may suffer arising from the Course or Motorcycling Activities, including claims based on the Released Parties’ negligence.
I HAVE READ THIS AGREEMENT AND BY SIGNING BELOW I AGREE TO THE ABOVE TERMS, AND TO ASSUME ALL RISKS AND RELEASE THE ABOVE-NAMED RELEASED PARTIES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

READ CAREFULLY: THIS IS AN INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
I, on behalf of myself, my personal representatives and my heirs, agree to hold harmless, defend, and indemnify the Released Parties from any and all claims, suits, or causes of action by any third parties, including Released Parties or other Course participants, for bodily injury, property damage, or other damages that may arise out of my participation in the Course or Motorcycle Activities, including claims arising from the negligence of Released Parties, other Course participants, or any other party.
I HAVE READ THIS AGREEMENT AND BY SIGNING BELOW I AGREE TO THE ABOVE TERMS, AND TO ACCEPT LEGAL RESPONSIBILITY AND PAY FOR ANY LOSS FOR CLAIMS OR LAWSUITS AGAINST THE ABOVE-NAMED RELEASED PARTIES ARISING FROM MY PARTICIPATION IN THE COURSE.

MSF LIABILITY WAIVER AND GENERAL RELEASE RELATING TO CORONAVIRUS/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.  COVID-19 is contagious.  The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact, by contact with contaminated surfaces and objects, and in the air.  People reportedly can be infected and show no symptoms and therefore spread the disease.  The exact methods of spread and contraction are unknown.
Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and death.  Even with social distancing, mask-wearing and development of vaccines, new and emerging variants of COVID-19 may increase risk of transmission and/or mortality.
The Motorcycle Safety Foundation, Inc. (“MSF”), the training sponsor, the owner of the training motorcycle and premises upon which training occurs, including each of their affiliates, subsidiaries, members, employees, officers, coaches, instructors, aides, and/or agents (the “Released Parties”) cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while participating in a motorcycle safety training course, other MSF-related training activities, or utilizing the Released Parties’ services or premises (collectively, “Training Activities”).  It is not possible to prevent against the presence of the disease.  Therefore, if you choose to participate in Training Activities, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK:  I have read and understand the above warning concerning COVID-19.  I hereby choose to accept the risk of contracting COVID-19 for myself, and for my family members or others who I may expose, in order to participate in Training Activities.  These services are of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to participate in Training Activities.

WAIVER OF LAWSUIT/LIABILITY:  I hereby forever release and waive my right to bring suit against the Released Parties in connection with exposure, infection, and/or spread of COVID-19 related to my participation in Training Activities.  I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

OTHER TERMS:  I fully understand and agree that (a) this Release is intended to be as broad and inclusive as permitted by the laws of the State in which Training Activities are conducted; (b) if any portion of this Agreement is for any reason held invalid or legally unenforceable, then the balance shall, notwithstanding, continue in full force and legal effect; and (c) I have had the opportunity to ask any questions about this Agreement and I fully understand its terms and meaning.
